CONDITIONS OF RAYXPERT® USE

RayXpert® is a software based on a statistical model Monte Carlo 3D to calculate photon and electron dose rate, the flux of particles and their spectrum.

GENERAL PROVISIONS: The use of this software is reserved to the professionals of such calculation (hereafter the Operator) who have attended to the RayXpert® training program organized by TRAD.

TRAD assumes no liability for the consequences of any use of the software which is not compliant with the provisions and instructions of the user manual. The manual also defines the compliance of the software with the relevant standards and good practice. Some databases delivered by TRAD may be modified by the Operator: the latter shall be sole liable for the consequences of any such modification.

The Operator is informed that on the one hand, as for any statistical simulation, the results obtained are submitted to a systematical bias compare to reality and on the other hand, some configurations of the model designed by the Operator may affect the precision of the calculation (effects known upon launch of the software are detailed in the manual, for example sky effect, overlapping effects). The exploitation of results is left to the interpretation of the Operator under his sole liability.

The results of calculation in a given configuration can never be extrapolated to any others, even if the Operator considers they are similar.

TRAD made its best efforts to validate RayXpert® by test cases and comparisons during the development and launch of the software; they are representative in their area of validity but they cannot be exhaustive and do not guarantee the comprehensiveness of the geometric or physical configurations that can be encountered by Operators. TRAD publishes the results of these validation tests and the Operator must refer to them to determine whether the software is proper to meet the intended use. Operators must develop their own batteries of tests representative of the configurations that they are likely to encounter if they differ from the published cases and they are invited to share the same with TRAD to increase the knowledge of the community of users.

BECAUSE OF THE DIVERSITY OF CONDITIONS AND HARDWARE UNDER WHICH THE SOFTWARE MAY BE USED, NO WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE IS OFFERED, AND TRAD DOES NOT WARRANT THAT THE FUNCTIONS OF THE SOFTWARE WILL MEET ANY REQUIREMENTS OF USERS.

WHEN THE OPERATOR USES THE SOFTWARE IN THE PROCESS OF DESIGNING A FACILITY LIKELY TO PRESENT A RISK OF DAMAGE TO PROPERTY OR PERSONS.

In addition to the General provisions, the following special provisions apply:

1 /-the model of the facility is the sole responsibility of the Operator, RayXpert® as a calculation tool provides an answer for any given plan and is not designed to optimize the same automatically; TRAD receives no obligation to advise the Operator in this regard in any manner.

2 /- RayXpert® as a tool for statistical calculation and simulation should be regarded as one source of information which cannot suffice to guarantee the conformity of the actual facility. The decision to implement the said facility purpose of a simulation and liabilities associated thereto and ensuing therefrom are incumbent solely upon the decision-making authority which must take all requisite professional advice to obtain sufficient safeguards.

3 /- it is equally essential to supplement the statistical results by measures in situ which are sole able to guarantee the security of any facility; they must be taken after the construction but before any acceptance and commissioning of the facilities in accordance with the applicable standards and regulations if any, or in accordance with the relevant state of the art, under the sole responsibility of the operator.

4 /- TRAD considers as condition essential to the sale that all these measures are carried out by the buyer in a timely manner and under the conditions appropriate to avoid damage to property or persons.

5/- Because of the unavoidable differences between the model of a facility used for a simulation and the facility when built, TRAD offers no warranty, whether express or implied, nor shall TRAD be held liable for any direct, indirect or consequential damages that may result from any difference whatsoever between the result of the statistical model and the measurements carried out in site.
